Welcome to wickerpark.ca (the "Site"), operated by 2549368 Ontario Inc., doing business as WickerPark ("WickerPark," "we," "our," or "us"). By accessing or using our Site, visiting our showroom, or placing an order with us, you agree to be bound by these Terms and Conditions (the "Terms"), as well as our Privacy Policy, Shipping, Orders & Returns policy and Warranty, all of which are incorporated into these Terms by reference. If you do not agree to these Terms, please do not use this Site.
1. Company Information
This website is owned and operated by 2549368 Ontario Inc. o/a WickerPark, located at 2550 Goldenridge Rd Unit 16, Mississauga, Ontario L4X 2S3, Canada. Unless otherwise noted, all content on this Site, including images, product descriptions, logos and designs, is the property of WickerPark or its licensors.
2. Use of this Site
By using our Site, you confirm that you are at least the age of majority in your province or territory of residence, or that you have provided consent for any of your minor dependents to use this Site. You agree to comply with these Terms and all applicable laws, and not to use the Site for any unlawful purpose, to interfere with its security or operation, to transmit malicious code, or to collect information about other users.
3. Consent to Terms at Checkout
By completing a purchase on our Site or in our showroom, you agree to be bound by these Terms, our Privacy Policy, and our Shipping, Orders & Returns policy.
4. Product Availability & Order Cancellations
Many of our products are made in limited quantities or to order. While we strive to keep inventory and lead times up to date, items may become unavailable or lead times may change without notice. We reserve the right to cancel or refuse any order at our discretion, including in cases of pricing errors, inventory issues, supplier changes, suspected fraud, or for any other reason. We may also limit or cancel quantities purchased per person, per household or per order, including orders placed under the same account, payment method or shipping address. If your order is cancelled by us after payment has been made, a full refund will be issued to your original payment method.
Customer cancellations are governed by our Shipping, Orders & Returns policy. Custom and made-to-order items, including custom Sunbrella fabric orders, may only be cancelled within the grace period stated there; after that, all sales are final.
5. Product Information & Colour Accuracy
We make every effort to display our products as accurately as possible. Due to differences in screen settings, lighting and natural variation in materials such as Sunbrella fabric, resin wicker weave and powder-coat finishes, actual colours and finishes may differ slightly from what appears online. Fabric swatches can be viewed in our showroom. If a product is not as described, your remedy is to return it in unused condition in accordance with our return policy.
6. Pricing
All prices are in Canadian dollars unless otherwise stated and exclude applicable taxes and delivery. We reserve the right to change pricing at any time without notice. In the event a product is listed at an incorrect price due to a typographical, photographic or supplier error, we reserve the right to cancel any such orders and refund the purchase. Our one-time price adjustment policy is described in our Shipping, Orders & Returns policy.
7. Financing
Financing is offered through Affirm Canada Holdings Ltd. on eligible orders and is subject to Affirm's own terms, eligibility check and approval. WickerPark is not a lender. See our Financing page for details.
8. Customer Reviews & Submissions
You may submit reviews, photos or other content to our Site or social channels, including under the #MyWickerPark hashtag. By doing so, you grant WickerPark a non-exclusive, royalty-free, perpetual right to use, reproduce and display that content in connection with our products, marketing or services. Reviews may display your first name and last initial. We will not publicly use your full name without your permission, and photos used for promotion will not include identifying information. You agree not to post content that is unlawful, defamatory, infringing or otherwise inappropriate. We may remove or moderate content at our discretion.
9. Intellectual Property & Trademarks
All rights, title and interest in the content of this Site, including images, graphics, text, product names and overall design, are owned or licensed by WickerPark. You may browse, download or print content for personal, non-commercial use only. WickerPark's registered, pending and unregistered trademarks, trade names, service marks and logos (the "Marks") may not be used, reproduced, displayed, published or transmitted without WickerPark's prior written consent or a written agreement between you and WickerPark. All other trademarks, including Sunbrella and Nardi, are the property of their respective owners. Requests to use the Marks may be sent to info@wickerpark.ca.
10. Communications
We offer email and SMS communications for order updates, promotional offers and customer support, in compliance with Canada's Anti-Spam Legislation (CASL). You may opt in at checkout or through our Site. Consent is not a condition of purchase, message frequency varies, and message and data rates may apply. You may unsubscribe from marketing emails at any time using the link in any email, and from SMS by replying STOP; we honour unsubscribe requests within 10 business days. Transactional messages about your order will continue as needed to fulfil it. SMS is governed by our Messaging Terms & Conditions.
11. Customer Service Correspondence
We aim to respond to inquiries within two business days, but we are not obligated to reply to all messages. Any comments, suggestions or ideas submitted to us may be used by WickerPark without restriction or compensation, and we are not responsible for keeping such correspondence confidential. WickerPark may share all emails and communications relating to an order or inquiry internally in order to resolve it, and may request photo identification and confirmed billing information where an order or return is flagged for verification.
12. Respectful Conduct
We are committed to a safe and respectful environment for our team, in our showroom, on delivery and online. We do not tolerate harassment, threats, abuse, discrimination or intimidation directed at our employees or contractors, whether in person, by phone, by email or on social media or review platforms, nor retaliation against employees who raise concerns. We reserve the right to refuse service, cancel orders or end communication with anyone who engages in such conduct. Concerns may be raised in confidence at info@wickerpark.ca, Attention: Compliance.
13. Fraud Prevention
We investigate orders, returns and claims that appear to involve fraud, including wardrobing or "free renting", returns of used, exchanged or stolen merchandise, price arbitrage, chargeback abuse, and false statements about fulfilment, pricing or product availability. Monetary claims that cannot be verified by a financial institution or a WickerPark associate will not be honoured. We may refuse service to anyone found to have engaged in such conduct.
14. Limitation of Liability
To the fullest extent permitted by law, WickerPark shall not be liable for any damages of any kind related to your use of, or inability to access, this Site, or arising from products purchased from us beyond the remedies set out in our return policy and warranty. This includes, without limitation, direct, indirect, incidental, punitive and consequential damages. Nothing in these Terms limits any rights you have under the Ontario Consumer Protection Act or other applicable consumer protection law that cannot be waived.
15. Indemnification
You agree to indemnify, defend and hold harmless WickerPark, its officers, directors, employees, agents, licensors, affiliates and service providers from and against all losses, expenses, damages and costs, including reasonable legal fees, arising out of or related to (i) your use of the Site; (ii) your violation of these Terms; (iii) any activity related to your account, including negligent or wrongful conduct by you or anyone accessing the Site using your account; or (iv) your violation of any rights of a third party.
16. Privacy & Cookies
Your use of our Site is also governed by our Privacy Policy, which outlines how we collect, use and protect your personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA), and how we use cookies.
17. Shipping, Returns & Warranty
Delivery, pickup, cancellations, price adjustments, returns and damaged-item claims are set out in our Shipping, Orders & Returns policy. Our 5-year Sunbrella fabric warranty and 2-year frame warranty, and the Nardi manufacturer warranty, are set out on our Warranty page. We ship within Canada only.
18. Third-Party Tools
Certain features on our Site rely on third-party tools or integrations, such as review platforms, financing, payment processors or embedded apps. We do not monitor or control these tools and disclaim responsibility for their functionality, availability or data handling practices. Your use of such tools is at your own risk and subject to the third party's own terms.
19. Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. You agree to submit to the exclusive jurisdiction of the courts of Ontario, Canada for the resolution of any disputes arising under or related to these Terms.
20. Changes to Terms
We may update these Terms at any time. The latest version, with its effective date, will always be posted on this page, and continued use of the Site after that date constitutes your agreement to the updated Terms.
